GENERAL TERMS AND CONDITIONS
TRAVELMANIAC LLC
1. INTRODUCTORY PROVISIONS
These General Terms and Conditions ("Terms") govern the contractual relationship between the client ("Customer") and TravelManiac LLC, registered office at 30 N Gould St, Ste R, Sheridan, WY 82801, USA, registered in the State of Wyoming, USA, EIN: 61-2254351 ("Company").
By using the website TravelManiac.org or making a booking through the Company, the Customer acknowledges that they have read, understood, and agreed to these Terms.
The Company acts solely as an intermediary of travel services, not as a provider or tour organizer.
2. DEFINITIONS
"Intermediated Services" means services provided by third parties offered through the TravelManiac.org website, including but not limited to accommodation, flights, transfers, car rentals, eSIM, and travel insurance.
"Service Provider" refers to any third party whose services are intermediated by the Company (e.g., GoGlobal Travel, RateHawk, TBO, APG Platform, Airalo, ERV).
"Customer" means any natural or legal person who orders one or more of the services offered via the Company's website.
"Booking" means a confirmed order of a service that is established upon payment and confirmation by the Company or the relevant Service Provider.
3. ROLE OF TRAVELMANIAC LLC
TravelManiac LLC acts solely as an intermediary between the Customer and the Service Provider.
The Company bears no responsibility for the quality, availability, or scope of services provided by third parties. Any claims relating to service performance must be addressed directly to the respective Provider.
The Company is liable only for the proper intermediation of the service, not for its actual provision.
The Customer acknowledges that by making a booking, a contractual relationship arises between the Customer and the Service Provider, not between the Customer and the Company.
4. INTERMEDIATED SERVICES AND PARTNERS
The Company cooperates with selected global partners whose offers are made available to Customers through its online system: GoGlobal Travel, RateHawk, TBO, APG Platform (flights), Airalo (eSIM), and ERV (travel insurance – available only for Czech travelers).
The Customer acknowledges that by booking a service through the Company, they also agree to the applicable terms and conditions of the respective Service Provider.
The Company shall not be held liable for any changes, cancellations, delays, losses, or other circumstances arising from the acts or omissions of the Service Provider.
5. BOOKINGS AND PAYMENTS
Bookings can be made online via the TravelManiac.org website. Upon submitting an order, the Customer receives a confirmation email with payment instructions or confirmation of receipt of payment.
Prices are displayed in various currencies according to the Service Provider's offer. The Company reserves the right to charge in a currency different from the displayed one.
Payment must be made in full by the specified deadline. If payment is not received, neither the Company nor the Provider are obliged to confirm the booking.
The Customer must check all information in the booking confirmation. Any discrepancies must be reported to the Company without delay.
6. CHANGES AND CANCELLATIONS
The conditions for changing or canceling a booking are governed by the applicable terms and conditions of the relevant Service Provider.
TravelManiac LLC, as the intermediary, is not responsible for any fees or losses arising from cancellation or modification of services by the Provider.
The Customer acknowledges that certain bookings (e.g., special offers or "non-refundable" rates) may not be subject to cancellation or modification.
In the event that the Provider issues a refund for a canceled booking, the Company will transfer such amount to the Customer once it has been received by the Company.
7. COMPLAINTS AND LIABILITY
Complaints regarding the actual performance of a service must be submitted directly to the Service Provider, in accordance with its procedures and deadlines.
TravelManiac LLC is not liable for the Customer's subjective satisfaction, aesthetic perception, or personal expectations regarding the provided service.
The Company is only liable for proper intermediation – that is, correct receipt of the order, its processing, and transmission to the Provider.
Should there be a proven fault of the Company in the intermediation process, its liability shall be limited to the maximum amount of the booked service price.
The Company shall not be held liable for any damages resulting from force majeure, technical issues, natural disasters, strikes, government actions, or other events beyond its control.
8. PRICES, CURRENCIES, AND FEES
Prices displayed on the TravelManiac.org website are valid at the time of booking unless otherwise stated.
Prices may be shown in various currencies depending on the Provider's offer. Currency conversions are based on current exchange rates or the terms of the payment processor.
The Company reserves the right to charge a handling or service fee for intermediation. These fees are always disclosed before confirming payment.
In the event of a difference between the display currency and the billing currency, any exchange rate differences shall be borne by the Customer.
9. REFUNDS
Refunds are only possible when the Service Provider approves them and releases the funds back to the Company.
The Company is not obligated to provide refunds unless it has received the corresponding amount from the Provider.
Bank transfer fees, currency exchange costs, or payment processor fees may be deducted from the refunded amount.
Refunds are issued using the same payment method as the original transaction unless otherwise agreed.
10. INSURANCE AND eSIM SERVICES
The Company offers travel insurance exclusively through ERV, and only for customers residing in the Czech Republic.
eSIM services are provided through Airalo; their activation, functionality, and coverage are governed by Airalo's terms and conditions.
The Company is not liable for technical issues, signal loss, or service limitations arising from local conditions or provider decisions.
11. PROTECTION OF PERSONAL DATA (GDPR / Privacy Policy)
TravelManiac LLC processes Customers' personal data only to the extent necessary to mediate travel-related services.
Processing is carried out in accordance with EU Regulation 2016/679 (GDPR) and other applicable privacy laws.
Data are stored securely and are not shared with third parties other than essential partners (service providers – hotels, airlines, insurers, etc.).
The Customer has the right to request access to, correction, deletion, or transfer of their data, or to file a complaint with the relevant data-protection authority.

12. INTELLECTUAL PROPERTY
All content on TravelManiac.org (texts, logos, graphics, photos, layouts, code, design) is protected by copyright and is the property of TravelManiac LLC or its partners.
Any copying, modification, or commercial use without the Company's written consent is prohibited.
Names, logos, and trademarks of partners (GoGlobal Travel, RateHawk, TBO, APG, Airalo, ERV, etc.) remain the property of their respective owners.
13. JURISDICTION AND GOVERNING LAW
These Terms and Conditions are governed by the laws of the State of Wyoming, USA.
Any disputes arising from the contractual relationship between the Customer and the Company shall be resolved exclusively before the competent courts in the State of Wyoming.
Should any provision of these Terms be found invalid, the remaining provisions shall remain in full force and effect.
It is noted that these Terms do not replace legal obligations arising under the laws of the country where the service is actually provided.

Customers are encouraged to regularly check the current version of the Terms on the website.
By using TravelManiac.org or placing an order, the Customer confirms that they have read, understood, and agree to these Terms.
These Terms are issued in Czech and English. In case of interpretation discrepancies, the English version shall prevail.
